Elphaba going legal - breakdown
So with this recent bout of legal threats I thought I'd do a little bit of a reality check.
Didn't use AI for this and all my references are at the bottom with links, sorry its so long I got a bit too enthusiastic
Ok so take the case of Cam2's that Elphaba wants to sue presumably for defamation and loss of earnings.
Let's say the Cam2 started a year ago and has alleged that Elphaba has talked inappropriately with children. Elphaba is going to have to prove:
They have not talked inappropriately with children and it is unreasonable that given the available data, anybody would believe that they have done so, and that any reasonable person would believe that they have based on the Cam2's words.
That they have suffered a loss of earnings because of the allegations if they are proved to be untrue. This means that Elphaba is going to have to prove that a specific individual has caused for them to have reduced earning opportunities or have lost revenue streams as a result of the allegation.
Ok well lets break this down:
Elphaba would claim both slanderous defamation in this case as the defamation is spoken rather than published.
Talking to children inappropriately - Elphaba has admitted on numerous occasions to talking to minors in that chat with Jordan Dash^(1), regardless of them flip flopping around the topic saying it was AI etc, they have admitted to talking to these minors and given the recordings^(2) of them talking to minors there is more than enough evidence for any reasonable person to believe that their behaviour is predatory and is inappropriate with minors. Any Cam2 alleging that Elphaba has talked inappropriately with children is doing so because they have seen this evidence. These videos came out before any Cam2 came about, if Elphaba does genuinely believe that these recordings are fabricated then they need to go after those that manufactured the videos and then knowingly distributed this false information not those who believe it.
Loss of income - Lets say the Cam2 Elphaba wants to sue has indeed defamed Elphaba, now Elphaba needs to prove that there has been a loss of income^(3). Elphaba is a public figure therefore there are different expectations when it comes to damages and public figures are expected to tolerate more scrutiny and have a lower expectation of privacy.
To prove loss of income and to be able to demand retribution Elphaba needs to show that before the specific individual being sued has had a direct impact on their earnings and earning potential, Well in May 2025 Elphaba was earning a pittance on TikTok lives similar to now and had absolutely no collaboration or PR opportunities to speak of, in fact with Elphaba bragging about the money coming in from vlogs^(4) and Cameos they might actually be earning more than they were a year ago.
Elphaba may be under the impression that because people have earned money from speaking about them that in a civil case where Elphaba wished to seek damages then they would be entitled to all that they have earned if not more, however this is contingent on many factors and in the case of the Cam2'er it would not be the case at all.
The cost of suing:
If Elphaba wanted to sue just one Cam2'er then this is the expected costs as this is not something Legal Aid covers^(5) and very few "no win no fee" firms take defamation suits (especially cases such as these one imagines) so this would have to be paid out of pocket from Elphaba:
Initial consultation - £0 - £100
Solicitor Letter - £200 - £1,000
Pre-action work under the defamation pre action protocol - £1,000 - £5,000+
Evidence review, correspondence, drafting
Identifying the individual - £5,000 - £20,000
Norwich Pharmacal Order, court fees, barrister fees, solicitor fees, and even then TikTok may provide limited information.
High Court fees - £569+
Barrister fees - £2,000 - £15,000
In total £8,769 - £41,669 (if Elphaba loses then they may be ordered to pay a portion of the defendants legal fees which could add another £10,000 to the total)
Stalking and Harassment:
Elphaba also claims that they are being stalked and harassed^(6) and that this is the fault of the Cam2'ers. However as a public figure the scope is different, the threshold for legal wrongdoing is higher for public figures^(7) and there is numerous case laws that protect the right to free speech and ability to criticise public figures. If the commentary is not abusive, threatening or malicious (which in the vast majority of cases it is not nor is there proof of such) then Cam2'ers and indeed the wider community are free to express their opinions on Elphaba persistently regardless of if Elphaba likes what they're saying or not. As an infamous celebrity^(8) Elphaba is subject to criticisms and. commentary, and as for the doxxing, they regularly reveal their location thus are not being doxxed. Additionally the cost to pursue this legally would be similar to that of the defamation case. Whilst Elphaba may have a slightly better chance with a harassment and stalking suit, it would be equally expensive and difficult to prove.
Other considerations:
Elphaba suing one individual is a drop in the bucket, even if Elphaba were able to successfully sue one Cam2 there are dozens more, many of which are international making it practically impossible to comprehensively sue every single Cam2 and it still does not stop any new ones appearing - its a never ending battle and it is one that Elphaba cannot afford nor will win.
Elphaba's online conduct is hardly one that is going to work in their favour. Elphaba has run the streets supporting Hamas hours before a terrorist attack on a Synagogue on Yom Kippur^(9 10). By Elphaba's logic if Cam2's are responsible for the honking^(6) by means of influence who's to say that they aren't in part responsible for that attack (naturally incredibly unreasonable but that is the nature of Elphaba's reasoning). They have repeatedly called for the death of the American President^(11), have buttered on lives (not going to post the links obviously but most of us have seen them), has set their supporters on a mission to find out private information on private people who disagree with Elphaba so that Elphaba can blast it over social media and dox them^(12), has threatened to attack members of the public^(13), has scammed children on Roblox^(14 15), has defamed Gender GP^(16) saying they scammed E despite it being a misunderstanding on E's end, telling people in CLA's chat to find a bridge (one of many times Elphaba has instructed the "haters" to act in such a nature^(17) and many more illegal behaviours I'm sure. All of this is hardly going to work in Elphaba's favour and personally I believe that the intended distress caused by Elphaba's butterings and telling people to find bridges are more than enough to counter sue and seek retribution of our own.
Their relationship with TikTok. If Elphaba chooses to attack TikTok or blame TikTok for their treatment then the protection TikTok currently offers Elphaba despite their numerous and continued Community Guidelines breeches, the TikTok may choose to cut their losses and go about banning Elphaba on a more permeant basis, and whilst Elphaba claims to be making money on Kick, if there was no more exposure of them on TikTok, positive or negative from any creators, then the interest would soon shrivel up. Elphaba as it is doesn't pull in a big audience on Kick, remove Cam2's, clips and their own TikTok page then there would be very very few people who bother to comment or buy cameos. Elphaba seems to be making money via other streams (wonder if HMRC know about that) as they are able to splash the cash on awful lip filler and tans, but how long can that be maintained, does Elphaba really want to alienate themselves from one of their few revenue streams?
Evidence review, if Elphaba were to sue a Cam2'er or anyone else they they would as part of the evidence review have to give over their Meta data and device history for the defendants side to review. Now if Elphaba has information on there that does not pair with the narrative they have spun, including texts and voice notes that they may have deleted then they might want to carefully consider whether they want the defendant having access to this information to present in court.
Overall:
Overall, if Elphaba were to sue they would need to be very precise over who they sue and what for; their best bet is Jordan Dash or whoever they believe doctored those voice notes (if they were indeed doctored) because anybody after those voice notes were published talking about them and believing them were doing so reasonably and cannot be found libel for that, it is far too expensive and with an incredibly low chance of success to reasonably sink tens of thousands into cases that are impossible to win and would be too numerous. Elphaba needs to accept reality and become a better person and realistically if social media is as bad for them as they say it is then they need to come off it. It is not the responsibility of individuals who wish to exercise their free speech to critique Elphaba to safeguard them or restrain because Elphaba doesn't like negative attention or unfortunate truths about them being spread, as they have declared numerous times on instagram descriptors , being on cameo which is for celebrities^(18), or on numerous lives over the years^(19) , they are famous and a public figure and unfortunately for them that allows the public to critique them, redistribute their public content with their own commentary, and Cam2 them, this whole legal nonsense is a farce and is a total dead end, but selfishly I kinda hope they try it.
