Hello, We trying to submit an 1-485 and a I-130, (marriage based) but i am completely confused on the fee waiver for I-485. Me and her qualify for the 1-912 via income, and finacial hardship, but I know that there are circumstances where you are not eligible. I'm seeing in the actual eligibility form, and since that since she is an Asylee who was granted Asylum and is already the U.S, she is eligible for the form. But I am also seeing that family based applications are not eligible, but I dont explicitly see it in the eligibility form.

But if she filed as an application as an asylee based and not marriage based there are no restrictions of the fee waiver, in fact the adjustment of status may be free. What is true and what is not?
