Governor Kathy Hochul stated in a private meeting that she plans to opt New York into the new federal scholarship Education Freedom Tax Credit (EFTC) program.

That means New York families could soon have access to a dollar-for-dollar federal tax credit of up to $1,700 for donations made to Scholarship Granting Organizations (SGOs), helping create scholarship opportunities for K-12 students. This can support private school tuition, but also public school students through things like tutoring, technology, and after-school programs.

Beginning January 1, 2027, individual taxpayers may be able to claim a Federal Scholarship Tax Credit (FSTC) for certain cash contributions up to $1700 to Scholarship Granting Organizations (SGOs). A state or the District of Columbia (state) must choose to participate in the FSTC and provide a list of SGOs in that state to the IRS before an individual taxpayer can donate to an SGO within that state and claim the FSTC.

Josh Shapiro hasn’t opted PA into the Education Freedom Tax Credit yet and that’s the whole issue. This isn’t complicated. It’s new funding for tutoring, scholarships, after-school programs, not coming out of school budgets. But if PA doesn’t opt in, the money goes to other states. So while we’re “waiting,” other states are actually putting it to work for their students. At some point it’s just… why wouldn’t we opt in?
