I received a section 21 last week, dated the 30th April asking me to leave within 2 months. From my understanding a section 21 cannot be served during a fixed term contract unless there is a break clause. My query is that our break clause is clearly stated to be at a set date in our 2 year contract and that date has passed.

“Both the tenant and the landlord shall have a mutual right to terminate this agreement at 14th of September 2025 on the service of at least Two Months written notice prior to that date.”

Am I right in thinking this means that our contract has continued in the second year of a ftc? Any advice appreciated!

I’m due to have ACL reconstruction with LET and potentially meniscus repair in just over a month. Looking to plan where I’m going to recover and considering going home to family for the first few weeks. How bad of an idea is this? Will I completely hate myself or will the drugs make the journey bare-able?

For additional context, my landlord is trying to evict me (through no fault of my own) which would mean having to navigate moving out whilst recovering if I don’t do the journey post surgery.

Last night we were served a section 21, dated 30th April (lovely gesture to wait to give us the absolute minimum time to find other options…). The notice came 2 weeks after I reported a serious concern regarding hearing rats in the walls of the house, a concern that 2 weeks on is still showing as waiting landlords approval on the maintenance platform. I’ve even phoned up the estate agents to ask what is going on and they told me they could not get hold of the landlord and then proceed to serve a section 21 2 working days later. 🥴

On top of this the communication regarding the section 21 to me, is misleading, they had told us that we are required to move out on or before 2 months from the date on the section 21 an have even asked us to sign a document to confirm this. From my understanding this is not at all how it works and a clear attempt to pressure us in to complying with their made up rules.

To add complexity, I am also due to have ACL surgery a week before our supposed “eviction date” meaning I’m expected to manage moving out whist being non weight bearing and find accommodation in a housing market with no properties available.

Also worth mentioning our contract ends in September, surely not worth the landlords time in fighting us in court?
