Thought on FMLA before served Pivot
My husband (10 year tenured L6 SDE at Amazon - I also am a L6 SDE) has been on focus for about 2 months and got en email suggesting that discussing the path forward for not meeting the focus criteria will happen next week (we vehemently disagree with this…). He’s already spoken to his PCP about high anxiety around work a few months ago and was prescribed medication (she is a very understanding doctor well versed in what Amazon does to her patients).
Should he apply for FMLA immediately before being served the Pivot documentation, given we believe his doctor would support? IIUC if he’s served, FMLA won’t help during the 5 business day decision period and he will default to the 60 days of transition period option. I also believe stocks will vest for up to 180 days while on FMLA. Once FMLA would be over, would he be then be served Pivot docs and be given the same 3 choices (leave, 60 days transition, or improve)? He has decent sized RSUs vesting pretty soon. We are trying to weigh the options with the end of focus coming up soon.
Background: US Citizens without worry for visas. Both over 40 years old.
