Hi, I’d like some advice as I am not sure what the correct information or rights are regarding broker fees.

I’m currently looking for an apartment to move to this summer. My roomate and I will reach out via the listing and the listing agent responds saying that the apartment is no longer available. They then share some other places that are “not on the market” but they come with a brokers fee.

Is this legal?

I read the FARE act and it is not clear on apartments that are not listed yet. Would like some advice on this scenario. Thank
