I recently stumbled upon this unusual internet discussion about the mental and legal issues surrounding Erik Bernstein and have attempted to comment on one of his posts… Unfortunately (and not surprisingly) he has forced people to request to comment, so I’ll leave my response to his legal threats here:

Erik I’ve picked up your post here as part of my investigation into your claims against others on another forum, while you’ve focused heavily on 'evidence preservation,' there are several significant legal and factual gaps in this framing that are worth acknowledging:

  • Criticism vs. Harassment: Under both UK and US law, 'cyberstalking' and 'harassment' require a proven 'course of conduct' that serves no legitimate purpose (CPS Guidance). Publicly disagreeing with or mocking technical work—even in a dedicated forum—is often legally protected as freedom of expression or fair comment, provided it doesn't involve credible threats or doxing.
  • The Defamation Bar: For technical critiques to be 'defamatory,' you must prove they are factually false statements of fact, not just opinions. Labeling technical work as 'AI slop' or 'psychosis' is frequently interpreted by courts as subjective hyperbole or opinion, which is not actionable in a defamation suit.
  • DARVO Misapplication: You cite the DARVO pattern (Deny, Attack, and Reverse Victim and Offender), but this is a psychological concept, not a statutory crime (Judge Law). Legally, if multiple independent parties are raising the same concerns about your work, it is often viewed as public accountabilityrather than a coordinated criminal conspiracy.
