Overgrown Holly blocking communal walkway in HOA.

Hey everybody. This is a complicated subject in my area and the rest of the HOA doesn’t want to touch it with a 12 foot tall pole - so I figure I’d come here to people who usually know better.

There’s a 12 foot overgrown holly tree on the edge of a residents property that has overgrown about a foot and a half into a 4 foot wide walkway. it’s also that time of year where it gets its bee visitors. And their lesser friend, the wasp.

Unfortunately, there has been several cases of people getting stung near the Holly. HOA members are demanding the board have a professional prune the tree, and the homeowner of said tree is refusing to allow it and threatens to sue. It should be said that this homeowner of said holly is a shut in, and is not responsive to neighbors and requests.

As a board member who has to make these decisions, what would you recommend? This is NYC. A compromise is out of the question as the home owner is refusing to prune and threatening to sue and the resident who had been stung is forwarding her bill and several are threatening to stop paying dues until the tree is pruned.
