Next Step: Claim Denied for Failure to Attend Examination
Let's say the VA-contracted examiner schedules your exam on literally the only day of a week that you cannot attend and their contract does not require them to reschedule your appointment. Then let's say you called and asked the examiner to reschedule said appointment that you had no say in scheduling in the first place, and their response is to cancel your appointment without rescheduling it. Then, of course, the VA denies your claim simply because you did not attend this appointment, the date for which hasn't even arrived yet.
What is the best next step? Submit a new claim for the same condition or try a supplemental claim?
I assume Supplemental claim, except the form asks who has seen me for this condition. My issue is rather that I was not seen. So I'm not entirely sure.
