Two years ago, my brother moved to Sweden with his second wife (married in Belgium under the statutory regime). They bought a house there and brought their household contents from Belgium with them. This includes the portion of household contents he acquired during his first marriage and which was due to him. There are two children from his first marriage. They live in Belgium.

Now, my brother passed away last month. I am somewhat concerned about the settlement of the inheritance. I believe that, in principle, his two children are heirs to all his assets from before his second marriage and to half of the family home in Sweden. Or am I mistaken? Is there anyone who can provide clarity on this?

Twee jaar geleden is mijn broer met zijn tweede echtgenote (gehuwd in België onder het wettelijk stelsel) naar Zweden verhuisd. Zij hebben daar een huis gekocht en de inboedel van België meegenomen. Dus ook het gedeelte inboedel die hij verworven heeft tijdens zijn eerste huwelijk en dat aan hem toekwam. Er zijn twee kinderen uit zijn eerste huwelijk. Deze wonen in België.

Nu is mijn broer vorige maand overleden. Ik ben wat bezorgd over de regeling van de erfenis. Zijn twee kinderen zijn volgens mij in principe erfgenaam van al zijn bezittingen van voor zijn tweede huwelijk en van de helft van de gezinswoning in Zweden. Of vergis ik mij. Is er iemand die hierover duidelijkheid kan verschaffen?
