Thanks for everyone who commented on my last post. It's led to a follow up and I hope you all don't mind if I ask.

If my employer refuses to do anything other than bulk PAYE can I subsequently apply for a tax refund where significant money is allocated to **non- termination related** injury to feelings?

Hi all

I'm an LIP with an ongoing ET case. I'm hoping you can help me with my ongoing negotiations.

I have a fairly high value claim (SOL >£500k) and settlement discussions reflect that.

However, my SOL is net and the Respondent is negotiating in gross. With a high value claim this really hits hard on outcomes.

~40% of the sum remaining after the 30k is accounted for is a significant amount of money. It brings my effective compensation down dramatically.

Would the professionals mind explaining how this is generally addressed?

Can I use it as a negotiating stance to increase the settlement? Or is this just how it is during negotiations - Claimants are expected to absorb the tax loss?

Any insight greatly appreciated.
