

Hi, I live in a subdivision in Texas that does not have a sewer system so they designed it in a hill manner with swales in between each house so that the water drains downward to a retention pond. My neighbor completely changed the swale in between our houses and I am concerned. I hired a foundation engineer and he gave me the picture attached and said it’s supposed to drain. My neighbor basically put plastic tarp down then sand then river rock and put big chop block to enclose his side. He also added 6 inches of soil to his lawn so basically all water in the swale drains forward to my side. I didn’t think it’s terrible since it’s not going to my foundation and it’s just watering my from plants. But I am worried that since his side is flat and water is not draining that he could be impounding water and it can affect water underground and somehow affect my foundation. His side is the left side that is rocked in. My side is the right side with trash bins. I tried calling the county but they said it’s an HoA problem not theirs am I overreacting? Is this a small or big issue?
