asylum interview while waiting marriage based green card.
I need honest opinions about my immigration situation because I’m trying to make the smartest decision possible.
I entered the U.S. legally on a J-1 visa. My DS-2019 expired in early 2020 and I filed affirmative asylum before my status expired. I never had an asylum interview until now and I have never been in immigration court or removal proceedings.
Years later I developed a serious relationship with my now husband. We have been together for several years, living together, with joint taxes, loans, and shared evidence. We got married about 2 years ago and later filed for adjustment of status through marriage with USCIS. My current work permit is based on the pending I-485, not asylum.
My green card case has been pending for over a year and now I finally received an asylum interview notice.
The reality is that I no longer want to pursue the asylum process. My life is now completely centered around my marriage and adjustment case. Honestly, I have much more confidence in my marriage-based green card case than in the asylum case.
My fear is:
if I withdraw the asylum case before my green card is approved, could USCIS place me into removal proceedings even though I already have a pending marriage-based I-485 and have never been in court?
Has anyone gone through something similar?
