Hello,

My wife and I will get married in a month and she will to move to the US ( both Canadian) I have an H1B and she still is in Canada and will move in after the wedding.

To get the marriage certificate, it takes 16 weeks and that is too long. Would it be possible to cross the border as a visitor, get married in the States and adjust status when coming in to the US again or would that be seen as some sort of fraud?

Hi, I will be transitioning from F-1 to H-1B status in August 2026. I will also be getting married in August, and my wife (Australian) will be coming on H4.

- Both of us will be NRAs for 2026, and will stay in the US for 31 consecutive days and become duel residents for tax purposes and we expect to meet the SPT in 2027.

  1. Will the First-Year Choice allow us to be treated as resident aliens, claim the standard deduction, and file MFJ for 2026? If so, will standard deduction and MJF apply for full year or only months we were resident ?

  2. When filing my 2026 taxes in 2027, should I wait until I meet the SPT in 2027( will need extension) before filing, or can I file earlier?
