An immigration judge granted asylum in our case last year. DHS filed an appeal 25 days after the decision, within the 30-day window. The BIA rejected it because DHS failed to submit an EOIR-27. We also noticed that DHS had filled in an incorrect date on the filing.

Seven months later, DHS filed a second appeal. It currently shows as “received” and “pending” on the BIA system.

Our attorney described the second appeal as defective but has since become unresponsive.

Looking to hear from anyone who has seen something similar or has experience with BIA procedure.
