
Good morning everyone, I'm looking for guidance on how to approach this denial. In February I submitted my first FDC claim. I just got my ratings back for each claim, submitted 12, six were awarded five were deferred and one was denied. My claim that I had the most confidence in, just got denied. It's for nocturia(urinary frequency), I had a clear diagnosis from a civilian urologist and evidence explaining the frequency every night, all documented while still in service.
For each claim, I made a nice little packet with cover page, page reference sheet, then laid out my personal statement, then evidence. I had one C&P examiner do 8 of my claims, to include my urinary frequency claim. He must've missed that packet of evidence?
Here's my denial:
"The evidence does not show a current diagnosed disability. (38 CFR 3.159, 38 CFR 3.303) YourVA contract exam conducted March 09, 2026 does not contain a diagnosis for nocturia or urinaryfrequency.
Your service treatment records do not contain complaints, treatment, or diagnosis for thiscondition. Your service treatment records do not show urinary urgency, and/or frequency, and/orloss of urinary control.
We did not find a link between your medical condition and military service. (38 CFR 3.303)Without a diagnosis, the examiner is unable to consider a nexus (or link) between your claimedcondition and military service."
Sooo.. I've attached snips from my evidence packet, these all come from different pages of the 9 page packet but it's what you need to see to paint the picture of evidence I submitted. It couldn't be more clear right? What am i missing? I've also double checked my files on va.gov for my FDC and I confirmed that this packet is in fact in there.
So my question is, how do I proceed from here?
- do I submit an HLR? If so, do I take the informal meeting or just submit the HLR? Is there a way to submit HLR with a one liner telling them to look at "Urinary Frequency Evidence Packet?" I tried submitting HLR but couldn't find somewhere to just include that one line.
- or do I submit a supplemental and just reattach this evidence packet since im back to step three (for some reason) and let it play out that way?
- or is there a better option?
