Contractor damaged property
Commercial property landlord. Asphalt contractor laid asphalt patches. In doing so they damaged a clean-out and the vertical pipe and it’s filled with asphalt. We don’t know how much of the horizontal sewer line - 5’ below grade - is affected. Big plumbing company called by tenant and they quoted to cut asphalt and excavate and repair and put down asphalt. plumbing company says they will asphalt themselves (not sub out).
Original asphalt contractor has accepted responsibility. Original asphalt contractor has asked if I want to pay plumbing company or should contractor. Original contractor has some existing warranty obligations. But I want to assure that the plumbing repairs are warranted to me. And that original asphalt contractor repairs remain covered under warranty. Also that is plumbing company asphalt patch becomes a problem who warranties that?
