I’ve been working through u/stapelhills’ guide and wanted to sense check my interpretation of this section:
German mother and foreign father out of wedlock: The child was born as a German citizen. Did the father legitimize the child before 24 May 1949? If yes → Outcome 5. Otherwise continue with the next person in line.
Details:
Grandmother:
Born 04/08/1916, Düsseldorf (German)
Married British citizen: 04/06/1949
Naturalised British: 29/07/1949
Father:
Born 26/12/1948, Düsseldorf (out of wedlock → German at birth)
Not legitimated before 24 May 1949
Legitimated by British father at marriage to mother 04/06/1949 (there are German documents from 1950 confirming his legitimisation).
Me:
Born 13/04/1980, UK
Question:
Am I correct that my father was born a German citizen (German mother, out of wedlock in 1948), and that because legitimation by his foreign father did not occur before 24 May 1949, he would not fall under Outcome 5 of the guide?
If so, would his later legitimation in 1950 (by a foreign father) be considered a post–23 May 1949 loss of German citizenship under historic discriminatory legitimation rules, meaning I fall under §5 StAG (Outcome 3) as a descendant?
Just trying to confirm I’m interpreting the timing/cut-off correctly.
