Is Connecticut unique in the way its probate courts charge court fees? CT probate filing fees are based on the gross estate for estate tax purposes. This includes probate and non-probate assets. The exact fee is similar to a progressive tax and calculated as a percentage of assets. The probate fees range from $25 to $40,000 (estates over $8,877,000). Other states charge flat filing fees for of a few hundred dollars or have tiered filing fees based on estate value. I haven't seen any other state with a percentage-based system or one that results in five figure court fees. This is only the basic court filing fee, not including the executor fees, or copies of documents and other miscellaneous court fees.
