Hey everyone, I’m looking for some guidance on my immigration situation and would really appreciate any insights.
Here’s where I’m at: I’m a DACA recipient who’s been married for about 9 months now. I submitted my I-130 petition through my spouse a few months back and I’m still waiting to hear back. My DACA is set to expire in December, and I’m in the process of renewing it right now.
Here’s the tricky part, and this is what’s been keeping me up at night. I don’t have proper inspections on record from when I entered the country. I know that’s a complication, but I’m trying to figure out my best path forward.
My main question is: should I wait for my I-130 to get approved before applying for the I-485? And do I need to file a hardship waiver because of the inspection issue?
I want to do this the right way, and I’m trying to be strategic about timing. Any guidance would help a lot. Thanks in advance.
