Laid off from my H1B job, last working day was April 21. I filed H1B → F2 change of status on April 22 (well within the 60-day grace period).

Now I’m getting a new job offer. I had told the company I’d only need a straight H1B transfer, but now the pending F2 COS complicates things.

I’m considering 3 options:

  1. Ask company to file H1B transfer now, and separately withdraw my F2 COS myself
  2. Premium process the F2 first, get approval, then have company file F2 → H1B COS
  3. Tell company’s immigration lawyers everything and let them decide strategy (likely file H1B premium + withdraw F2)

My concern: I’ve seen cases where once USCIS sees a pending COS (especially F1/F2/B2), they deny it if H1b transfer filing comes in.

Would you:
- Push for F2 approval first for cleaner status?
- Go straight with H1B transfer + withdraw F2?
- Let employer lawyers handle it?

Anyone been through something similar?

I booked my parents’ B2 visa appointments when I was on H1B and employed. Their OFC appointment is on May 7 and biometrics/interview is on June 7.

My situation has now changed — I recently lost my job and have filed a change of status to F2, its status is pending.

My questions:

  1. What are the approval chances for their B2 now, given my status change?

  2. Should I reschedule/cancel their appointments?

  3. If they complete the OFC appointment, can I reschedule only the biometrics/interview for later? ( I have not used the limit)

Would appreciate any guidance from anyone who has dealt with something similar. Thanks.
