I have found varying interpretations of TUPE law around the transfer of liability to a transferee when an employee is an ex-employee on date of transfer, but where the employment tribunal case and therefore the acts of ”wrongdoing” belong to the transferor, and pre-date any mutterings of acquisition.

Can anyone shed any light, please? The ET delays may mean we see more and more of situations like this. Previously liability would ordinarily have been resolved as traditional ET timelines were just a few months.
