I went to a Cafe Nero about a month ago and spent £9.60. Since then, I have been getting declined transactions every single night at about 9.10pm (maybe when they cash up for the night?). It comes up on my banking app every single night without fail - Cafe Nero £9.60 - declined.

I contacted them to complain and got a response that basically said ‘We are sorry, this is outwith our control. It will continue to happen for *at least* 30 days. The money is being taken and then immediately returned to your account.’

Yes, not at the most 30 days - at least 30 days.

I don’t want compensation, just to make that clear. What I want is to understand my rights because I am concerned that they are retaining my card details.

Can I report them to the ICO for a GDPR breach? I really don’t like the idea that they are taking money out of my account, even if it is being immediately returned.
