Tenant rights
I am renting an apartment and my lease ends at the end of September. I am moving earlier than that date because of the level of noise coming from the neighbours plus the lack of security for this building.
I was planning on honouring my contract but that's an extra $6k to pay out for a space I won't be using. I'm wondering if I'll have to pay a half a month's rent for each month I leave if I'm leaving for mental health/health reasons.
I've filed multiple complaints through the rental company to the strata about the people upstairs. They've gotten better but still wake me up regularly. I've written two long letters explaining how disruptive their noise has been. I've written out a weeks worth of loud noises I hear through the day and night. They vacuum 3 times a day (even at 4am). The male wears heavy boots the entire time and constantly drops stuff on the floor instead of putting it down. They move furniture at all hours. Their teenager drops weights on the floor starting at 6am.
I don't know if this makes a difference but I'm medically retired and spend a lot of time sick in bed. I have sleep issues so the fact they wake me up several times a week has had a negative affect on my health.
I will be telling them I will not finish the contract and will be moving at the end of next month. I'm hoping to learn of my rights so I can word my letter appropriately.
Will they legally be able to hold my security & damage deposits?
