Ok so apparently it is legal to say weird things as long as it’s in a newspaper article. Basically I’m wondering if all newspaper articles published online are protected because the miller test requires that the material in question not have “literary value”. I came across a reporter who I’ve deemed to be incredibly obscene while covering guilty verdicts. The articles always contain WAY TOO MUCH graphic detail about the horrific (obscene) offenses the person has been convicted of and mainly focus on the explicit details. It’s very creepy, seriously. I looked up other articles on these types of topics to see if this is normal and it certainly seems abnormal and obscene. Is there anything that can be done in this case or any others involving newspapers explicitly describing obscenities? Thank you, in advance.
Edit: tl/dr - are there cases where newspaper articles aren’t protected by the fact that they theoretically have “literary value” and therefore can’t have the miller test for obscenity applied?
