Detainment clarity
Quick question as a CSO in Texas my management is pushing us to detain violators of criminal trespass notices solely based on this violation. The surface level research I’ve done aren’t clear. What I’ve gathered is the first step is to ask them to vacate and then escalate if they resist. I’m of the mind that I will tell the violator to leave and if they do not I contact law enforcement to arrest and do not detain unless they are a threat to safety or actively committing a felony in my view.
EDIT: Spoke with the owner of the company I’m interviewing with who’s a former state trooper and his answer was: yes I CAN detain but 99% of the time I should ask them to leave and deescalate the situation. Which is common sense but by law I’d be protected.
