EB1A RFE-> Denied
Profile: Field: Biomedical Engineering, 227 citations, 25 publications, and 50+ peer reviews supporting the judging criterion. Received an American Heart Association (AHA) grant during PhD training, previously worked as an Applications Specialist for a major microscopy company, and currently contributing to a critical government-funded project as a postdoctoral researcher at a national laboratory.
I applied for an EB1A petition, received an RFE, responded, and the case was ultimately denied. I am still waiting to review the denial notice in detail, so I am unsure of the exact basis for the denial. The case was filed under premium processing. Initially, four recommendation letters were submitted, followed by three additional letters and two testimonial letters in response to the RFE.
At this point, I am unsure whether it is better to refile immediately or wait, given the current adjudication trends. My NIW priority date is March 2025. I am considering changing attorneys from Chen and would appreciate any insights or recommendations regarding refiling strategy, timing, and attorney selection.
