Received a new charge while on probation.
Location: Oklahoma
So a friend of mine went to jail about a month ago or so for domestic assault and battery with a weapon, interfering with a 911 call, and resisting arrest. The girl filed a restraining order, and went back to court to get it extended. They already received a charge for violating that while in jail, and was given time served and released on a deferred sentence for the other three charges. Apparently, they were arrested for violating it again like two weeks ago, and an Application to Accelerate was filed. The girl went a few days after the arrest to dismiss the protective order, and the hearing is set for like two weeks from now. Furthermore, the arraignment for the ATA was moved to two weeks after the PO/PO Violation hearings. Does this mean that the violation charge will be thrown out because of her dropping the PO? And if so, does that mean the Application to Accelerate will be as well? I don’t think it was her that filed the new violation charge, so her dropping the PO doesn’t dismiss it right?
