I’ll keep the details of this post somewhat vague to avoid anything personally identifiable. For a period of several months at the end of last year, we had a repair dispute with our landlord that culminated in us getting the council involved. During this council intervention, an improvement notice was issued and the landlord was forced to make repairs.
After the repairs were completed, our letting agent proudly informed us that the landlord had managed to get the administrative charge associated with the improvement notice waived, as if to absolve him of any wrongdoing. We are unsure whether this means that the improvement notice itself was withdrawn, or whether the council simply did not pursue the admin fees associated with the notice of their own discretion. I believe they have the power to do this based on what I have read online.
Fast forward to now, and we have been told that the landlord will soon be serving us notice to vacate the property. This has not been formally issued yet, but I want to get ahead of this by checking my rights. It is my understanding that the landlord is currently unable to evict us with a section 21 notice due to the improvement notice issued at the end of last year, which should provide protection from retaliatory evictions for 6 months. In theory this should take us beyond 1st of May when section 21 evictions will be abolished.
Has anybody had experience with a similar situation, and can provide any advice about where we stand? Does an improvement notice provide the protection that we are hoping it does, and can it be taken away for any reason? For now, I will not be responding to any correspondence from the landlord or letting agent that is not made through the correct routes. I have emailed the council for advice, as they will ultimately have the answer, but they are unfortunately slow to respond at the best of times. I’m looking for advice or reassurance in the meantime.
