Check your lease agreement to make sure it's the right template. You may be able to withhold 1 month rent because of it, and potentially keep it. Read the website for more information. Overview is below

RULES:

  1. Make sure it is the correct template. If not, ask IN WRITING for an updated lease on the correct template

  2. Landlord has 21 CALENDAR DAYS to provide lease on CORRECT TEMPLATE.

  3. If landlord does NOT provide correct lease after 21 CALENDER DAYS, you may withhold 1 MONTH RENT.

  4. After withholding rent, landlord has 30 CALENDAR DAYS to provide lease on CORRECT TEMPLATE.

  5. IF after 30 CALENDAR DAYS landlord doesn't provide updated lease, you can KEEP THE WITHELD RENT.

NOTE: You can only keep 1 MONTH, and MUST CONTINUE PAYING THEREAFTER even if landlord doesn't provide correct copy. The LEASE YOU SIGN WILL REMAIN IN EFFECT.

Landlord can still file N5, but you will win, and can counterfile through "issues a Tenant wishes to raise at a rent arrears hearing" for free. Make sure you follow the rules on the Ontario Website.
