Hello y’all who keep me sane,

I’m a BOH worker, but my wife’s a bartender. I have a question relating to a tip pool. My partner is generally fine with being in a tip pool because of how their bar is setup, but today the AM was VERY slow (11-4, maybe $20 between the 2 bartenders). They’re usually open after 4 but to remedy these low numbers, they added the 2 ‘AM’ bartenders to the tip pool for the night (where they weren’t scheduled, they left at 3).

This seems, at the minimum, pretty f***ed and shady, I’m personally not even convinced it’s legal. So I’m just wondering about opinions from the other side who know more about it. Again, I’m BOH so I’m used to hourly, and not used to a tip pool. US. Rather not say the state if I can.
