Hi, I’m dealing with a messy flat deposit situation and need help figuring out what’s fair.

Details:

  • 5 girls: A, B, C, D, E
  • Monthly rent: ₹22,000
  • Total deposit paid: ₹50,000 (₹10,000 each)
  • Agreement started June 2025, moved in July 2025

What happened:

  • In December 2025, A, B, and C vacated:
    • A & B stayed till Dec 3 (morning) → paid ₹0
    • C stayed till Dec 7 → paid ₹903 only
  • Rent for December still had to be paid fully (₹22,000), so:
    • D & E covered most of it
    • A new tenant F was brought in and paid higher rent (since she had a single room)
    • Total rent for December was somehow managed and paid to the owner
  • Later:
    • By March 2026, another tenant G joined (so now D, E, F, G)
    • F & G did not pay the deposit, because A, B, and C’s deposits were still with the owner (they claim that he said he would settle it in May)
    • So their unpaid rent should be adjusted from their deposit
      • Also:
      • New tenants F & G are paying ₹5,500 each to D & E for May (₹11,000 total)
    • Main questions:
      1. Is it fair for A, B, C to demand full ₹10,000 back despite not paying December rent?
      2. Should December unpaid rent be adjusted from their deposit?
      3. Is it correct that May rent (₹22,000) is deducted from the total deposit of all 5 original tenants, even though only D & E stayed till the end?
      4. Who should bear the financial loss here?
  • Would really appreciate clear advice on what’s legally/fairly correct here. Thanks!
