Disability lawyer here. I'm not flaired in any of the lawyer subs so figured I'd just ask normally.
Background: In disability you have to inform SSA of all potential sources of evidence before the hearing (almost as simple as "we requested records from baptist hospital and they are being processed"). I got a medical opinion faxed in after hours the night before the hearing. The opinion had not been processed and uploaded to SSA, but we did inform the judge about it.
Events: We begin the phone hearing, I'm questioning. I ask my client a standard question, something like " are you able to keep a schedule?" to which the judge takes offense, asking for a cite in the file. I advise the judge that we had gotten this opinion recently, informed about it, would be uploading it immediately, and that Dr. Smith opined that my client could not keep a schedule. This made the judge livid, he berated me on record, made it clear to my client I was incompetent, made it clear to me he could not believe I would do that, and I felt that he was almost accusing me of being unethical. My behavior was so beyond the pale the hearing was ended, he recused himself, and said he would follow up with me personally (couple weeks ago, didn't happen).
Question: I suppose im just confused. These hearings are informal and non adversarial. Have argued and questioned on things not in record yet dozens of times (beside the point because i can question on anything). Been practicing a decade, few years in this field. Judge was new to me but goodness that seems a bit much for hazing. What am I missing?
