Hello long story short
We raised a case against a company who rent a shop from us in a very prominent location & we have a 10% profit sharing agreement with them.
They stopped paying in 2018 , finally got sick of their excuses , they thought we didn’t have a signed agreement , since we used to only put this clause in our internal rent contract yearly which was stopped around 2018 (we changed our team and they didn’t add this clause)
Our rent was much lower than the market price for rents in the area based on this profit sharing agreement.
The judge ruled in our favor but only gave us 300k for 6 years !
Court appointed auditor came to their office and even said to them their audit books provided weren’t from a recognized auditor company authorized by Dubai courts
We were unprepared but expected the court to come through after paying all these fees
After asking former managers and people affiliated with their company their profit was easily 3-5 million per year except for corona (2020)
The ruling was final , we appealed but nothing changed .
Now they are supposed to give us the 300k (court systems have been down so we haven’t received it yet ) & I don’t want to accept because it feels like accepting it means we accept this amount and accept this ruling which I don’t.
They told me the last step costs 20k more for a review if any internal rules were broken and most likely it will not be beneficial to our case.
Can anyone here give advice ?
