Using Jay's Treaty in 2026
So I'm Indigenous Canadian trying to get a green card/Social Security Number in the US. In theory, I should he able to use Jay's Treaty to live and work here with no issue. However, I've run into the issue of neither the government of Canada OR my band being able to write and sign off on a blood quantum letter, since that's not the way things are done anymore.
I have a status card, a letter from my band confirming my enrollment, and a letter from the Government of Canada stating that my entire mom's side is registered under the Indian Act (which is the only thing the government can provide right now in that regard). I've spoken to my band and they say that they can't write a blood quantum letter either, so I'm really lost on what more I can do, even though I know I qualify for it. I've been able to freely go between countries because of these, but when trying to get my Social Security Number, they told me that it wasn't enough.
Does anyone have experience with using the Jay Treaty in recent years? Or does anyone know what more I can do?
Sidenote: I am trying to do this because my partner coming to live up in Canada would be a significantly lengthier process + we were both accepted into a university down here. I would choose Canada over the US if it were less of a hassle (as I've seen with my sister's partner moving up there, which took months of paperwork).
