Confusion on Title IX investigation in Kansas

The school I work for has been the target of a Title IX violation investigation, as well as FERPA violations. My confusion in looking at as much as I could about Title IX is that it seems very vague when it comes to anything relating to transgender, which I know is the real main issue for the investigation. I have seen the supreme court go both ways with rulings related to this and more or less just wanted an explanation on some verbage. Title IX's main violation to hang its hat on is that there should be 'No discrimination based on sex' which makes sense. However, throughout the investigation we are essentially being told to discriminate against transgender kids based on their sex versus their gender. I understand the difference and what is being said, but I feel like the rules that are being implemented or suggested are discriminatory in their own right now, as some go beyond the level of what I think a safety net would be, almost as if we have to put a scarlet letter on these kids and treat them differently 100% of the time. Any conversation would be helpful for me, as I'm starting a family here soon in one of these districts and I just wanna know what I'm looking at right now.
