Likelihood of success, travel consent letter?
My ex refuses to let allow our children to travel to Mexico for my destination wedding. We are going to a place that has the government of Canada level 2 caution (essentially be vigilant but not the level 3 of avoid non essential travel).
Ex cites generalized safety concerns of Mexico for refusal. We have provided a detailed safety plan and travel itinerary and have demonstrated we are going to a safe place. Parenting agreement says the other parent will sign a travel consent letter. Both parents have travelled internationally with the children in the past so there is no other risk / history of no return.
What is the likelihood of having success with a court order to allow the kids to travel? My lawyers view is that ex is in violation of parenting agreement by not providing travel consent.
