I’m looking for legal advice for a prescriptive easement for water drainage that has been in place for over 20 yrs. A developer purchased the 1 acre lot next door to ours. We have been moving water through a ditch that connects into a natural waterway and the easement appears to be close to the neighbouring property line. The developer has not paid for a proper survey but instead had a surveyor company come to mark the property lines. He believes our prescriptive easement is on his property (which it appears to be) and has suggested he is going to remove it and restrict our access by filling it in. This will cause water to pool and flood out 3 properties. We have been told by the County that the prescriptive easement is considered a natural waterway. We are considering a court order to stopthe build until a judge can decide. What is a recommended course of action. We have already tried discussing this with the developer - he will not budge.
