I had my Preliminary Hearing in January and because my case is complex, the judge recommended my Final Hearing would take around 3 weeks. For this reason, its been listed for a Listing Hearing instead of a Final Hearing. He set dates for disclosure, bundle agreement and witness statement exchange all within the next 6 months and then in November, we will have this Listing Hearing to confirm if we will go to court. I think the presumption is we will settle in the next 6 months as evidence and witness strength becomes clear.
My problem is I've made an Application to Amend which R has objected to and the tribunal has told me I wont have an answer on whether it is accepted or rejected until 2 weeks before the FH because of the backlog! First of all- how is anyone supposed to prepare any new evidence/ witnesses within that time if it does get accepted!? Second- will I be able to get the Application to Amend accepted in this upcoming listing hearing or will I need to request a separate PH and push everything back again?
