Can anyone provide any information given the following facts in the United States? Not looking for legal advice, just any type of suggestions or clarifications if possible.
Someone files Chapter 13 Bankruptcy. They are $600K+ in debt. The debt includes credit cards, a new car that was purchased a month prior to filing, debt owed through a judgement, and various school and attorney debt.
They also owe someone else 100K+ for loaned money.
All of this said, they make $100K+ annually and currently rent (do not own any property aside from the new vehicle).
As a creditor, is there really nothing that can be done to collect Money that is owed through a judgement that was filed a few months prior to this individual filing for chapter 13?
Is the $100K+ loan money also just washed away via bankruptcy? This seems unbelievably unfair, and I have not been given any encouraging information when reaching out to other experts.
Would there be any benefit to filing an Objection to Confirmation (and if so, any advice?)
