I'm starting a new sales job soon where I will be working to provide sales consultations for a home remodeling company. They have told me it will be 1099 subcontractor work but after looking at some of the work I'm wondering if it may actually be a W2 position that has been misclassified.
So the current plan is to just keep very strict documentation on anything they send me that would point to it being W2, as I could file later to have refunds on my self employment taxes.
What I'm wondering about, is whether I should set boundaries during the job or not. And if I did how I should go about it. As a 1099 they should not control how I work or when I work. I personally want the freedom to be setting my own hours and to manage my own workflow. I am not their employee. I am a small business owner who is providing them a service. So I'm trying to decide if I should give push back if they try to act as if I am W2. And if I did push back what should I expect and how would I professionally word it. Would I basically be committing career suicide if I acknowledged the 1099 and set the proper boundaries.
I know you can't give great advice not knowing the specifics considering this is a new job I haven't started yet, but any thoughts or ideas I haven't considered would be helpful.
