I765 Withdrawal Time line 2026

Hi,

I need to withdraw my pending I765 because I filed early that acceptable window. I am done with my biometrics and now I am just waiting. I intend to apply again, once I am done with my withdrawal.

I saw, a couple of folks are also in the same boat. So, I just wanted to know the average time line for withdrawal application with and with out premium processing.

This will help others too for the future reference.

Hi,

I have applied for I765 for STEM OPT, but I realized that I made a mistake and that will cause me a denial. I have roughly 9-10 weeks from now for my OPT to expire. My DSO is not much helpful with all of these.

Currently, I am thinking of a couple of options :

  1. I file for withdrawal, wait till withdrawal gets approved, and reapply with a new I765 application. The risk with this option is uncertainty in the withdrawal process and how much time it will take to withdraw. Does anybody have experience with withdrawal? Please let me know!
  2. I can premium process my existing application and get a denial on it. I can reapply with a new application. The risk with this option is any consequences of denial from STEM OPT (I am not sure what the risks are) also it is going to be a financially stressful option.
  3. I apply for withdrawal, and I can start a new I-765 application with 'old' but valid I-20 (It is still within the 60-day window). This is a much faster option, but I am not sure how USCIS will handle 2 pending cases with the same i20. My DSO will not issue an I-20 unless I present them with a withdrawal notice or denial processing.

Please let me know your thoughts, and any help will be much appreciated.

Edit: The mistake was that I applied early than 90 days window.

I want some clarity based on real experiences. I applied 95 days before EAD expires (instead of within 90 days) for the STEM OPT I-765. However:

b)USCIS has requested biometrics on 4th May.

Has anyone had their STEM OPT denied for filing a few days early? If so, in what stage of the application (Initial stage or later?) If I decide to withdraw my application, how much time should I expect USCIS to process my request, and how soon can I apply again? Are there any obvious consequences of withdrawing and applying again?
