Can my property be protected from my husband’s judgement? I had no knowledge of or part of a business loan that he personally guaranteed then defaulted on. Where/who do I go for legal help? I’m desperate and afraid.

I’ve been blindsided over the discovery of my husband's business debts and obligations. How do I protect myself and my home of 20 years from my husband's judgement?

The scenario:

  • Early 2006 I purchased my home, independently, as a single mom, with my money. Mortgage & utilities are/have always been solely in my name.
  • Got married late 2006.
  • 2017 my husband applied for a HELOC independently. Credit union required a procedural quitclaim title change to facilitate his HELOC. Husband did not purchase ownership interest with title change.
  • Somewhere between 2022-23 my husband's business received an investment from an individual. The investment was later restructured into a business loan that my husband personally guaranteed. All of which occurred without my knowledge or participation. I received no benefit from the loan and do not know the creditor.
  • 2025 husband restored title back to me as the original owner via quitclaim.
  • 2026 husband defaulted on loan, creditor sued, and husband now has a recent judgement.
