I received an offer from a HF that includes a first-year guaranteed bonus. My lawyer suggested asking them to clarify that “poor performance” is excluded from the definition of “Cause” for purposes of forfeiting that guaranteed bonus.
The company said this change would need to go back through the approval chain. I’m trying to understand how common or reasonable this request is in finance/hedge fund offers, especially when a first-year bonus is described as guaranteed.
Has anyone negotiated similar language? Did it create issues with the employer, or is this a normal ask through counsel?
