My husband, 2 cats and I rented a ground floor unit of a house (another tenant on the top floor) in Indiranagar starting in November last year.

One Sunday, in late Feb, we left our cats at home and went shopping only to get a call from our neighbour asking to come home immediately. The porch roof (baraanda roof) had collapsed.

The damage: Entrance was blocked, we had no way of getting in, windows on the front was smashed, cats were terrified and had slight cuts (1 had a cut on its paw and the other had a cut above its eye). Home was fine from the inside.

We called the owner and he was 100kms away but he came as soon as he could and arranged for people to clean a little debris so we could at least get in. We were stuck outside for 6 hours. The first thing the owner said was that I bought this house a few months ago and didn’t know that the foundation was weak (the roof collapsed because it had no foundation pillar support). You can look for a different house if you want. I won’t stop you. Us: What about the Deposit? Him: Ya, Ya don’t worry about that. Us: Okay.

We were out of town for a month and it took us a while to search another house and the move in date is mid-may. (Our parents are coming in May end and we don’t want any mishaps like these. Once was scary enough and we don’t want to take any chances) The owner was gracious and said to take our time. We informed him of the move and he said okay. There’s just one nail in the wall where we hung a clock. Except that, We’ve kept the house in pristine condition. Even fixed the plumbing issue for both bathrooms ourselves.

Basis the above situation, can we get our full deposit back? (Rent agreement says 1 month cut for maintenance and painting) If the owner tries being difficult, how do we fight it? We’d like to resolve it as diplomatically as possible and without involving the authorities because we just don’t have the bandwidth to waste time like this. Office will be impacted and we can’t afford that. But one month rent is a lot.
