I still can't get a straightforward response to how national importance is shown in 2026

It's no secret that USCIS is scrutinizing that prong much more in 2026.

The old guidance is to show federal alignment and federal level problem quantification, and demonstrating how your endeavor aims to address that nationally recognized problem effectively.

However, we all know that this no longer works with tighter standards. So my question is what moves the needle now? I've seen AAO decisions that explicitly state that demonstrated impact is not necessary to show national importance, and that wouldn't even make sense for this legal framework as the NIW isn't a reward for doing good work.

So what kind of evidence exactly demonstrates that your endeavor is in the national interest? Do you need someone up there in the government to state that we can't lose this individual?

Is it possible to refile the same evidence and get reapproved?

I'm curious if one gets denied and decides to make an extra clear petition letter combining evidence from the RFE and original, could they get approved with just a different more lenient officer?

Or would the new officer moreso just review the previous denial and piggyback on it?

How does one show national importance in 2026? Is demonstrating real world uptake of your work necessary to demonstrating national importance?
