I don’t think I need advice, but I wanted to share and get your thoughts.
Let me give you some back story:
I put a contingent offer in on a home almost 2 months ago (they would be allowed to accept other offers). Immediately the next day, they lowered the price (just a tiny bit over what I offered) and got a new non-contingent offer they accepted and dropped me a week into my offer. Well, that buyer dropped out after the seller wouldn’t repour the entire very large driveway that has a rough surface in many areas (the driveway is not great, but a lofty lofty ask for them to do seeing the driveway isn’t that bad.)
The seller came back to me asking if I would like to offer again and I did because my other offer on a new house fell through as well (unrelated). They asked for all the repairs to be listed in the offer and that they would not be making any other repairs. I understood their frustrations, asked for all the things I wanted, and a little more concessions than the first offer I sent since they wasted my time with the first offer.
Everything was accepted and we also mentioned that there is a repair needed to add two large vents to the utility closet housing the water heater and furnace that we didn’t put on the offer but we think the installer of the HVAC system should have done at that time to properly ventilate it. I was okay with having to do the repair myself if it was going to cause issues.
Well they called said the handyman is there and that he could do the work. We sent a TRR for all the repairs and everyone signed.
NOW, they asked for $500 yesterday… we said no, today they sent an addendum reducing concessions by $400 (a new amount, no typo). We said no, the repair was in the agreed upon TRR.
The sellers agent said “the seller was under the impression that any other repairs not in the original offer would be paid for by the buyer”. Well… then why did you sign the TRR.
Closing is in 2 days and while I know that they can’t back out without implications, it still makes me anxious.
