Amazon trying to fire me
Location: California I work in California and was injured after an altercation with a coworker at work. I reported the incident to onsite HR in writing the same day and later developed a diagnosed shoulder labrum tear. I initially opened a workers’ compensation claim, but I eventually closed it because I felt my injury was not being taken seriously and treatment was delayed.
I then went through my personal insurance and saw an orthopedic surgeon. I received a shoulder injection and am now awaiting surgery. My doctor provided written work restrictions and requested temporary light duty accommodations.
My employer denied the accommodation request in writing, stating my restrictions could not be accommodated. I was then placed on a leave of absence. The leave was initially approved, but after I submitted an extension while on California State Disability, the extension was later denied.
I also requested copies of reports related to the workplace incident, but my employer has refused to provide them. I have:
- the written HR incident statement,
- accommodation denial paperwork,
- medical documentation/restrictions,
- orthopedic records,
- proof of leave approval and later denial,
- and state disability documentation.
I am now concerned about possible retaliation, disability discrimination, failure to accommodate, wrongful termination, and whether my workplace injury should still be connected to workers’ compensation.
