Alight need advice. Didn't know CC&R was a thing after years of home ownership. Nobody in neighborhood does except one original neighbor.
Added a detached garage approved and permitted by city after construction neighbor said it violated the CCRs and will sue me for the lost value and or to enforce architecture changes.
I dug though all the records and found the rules which the building violates, however the subdivision has at least 5 others with the same violation, buildings that have been there years. The CCRs also reference people who are responsible for approving any changes to the neighborhood (fencing shrubs anything that changes the likeness and original character of the subdivision). Only thing is, there is no contact info and names are generic. City has no records further. The CCRs are in perpetuity owned by these people and delegated as they see fit. I doubt anyone actually got their permission.
Is this a common situation? Fixing the building would be very expensive and serve no purpose, not even aesthetically. Can a neighbor target another neighbor or must be target all violations of the same type?
What are your thoughts? Without lawyering up, what good options could I take besides talking with the neighbor. He's pretty set that he's going to make money off me by claiming loss of value.
