I was recently working for an independent distribution warehouse owned by an umbrella company along with a number of other location. I told my boss a few months ago I was moving and he said another location where I was moving to needed a driver. He and the other locations began working on getting me transfered over, in the meantime a 3rd party courier was use. The day before I left, on my last day of work, I was informed that they transfer was canceled, position eliminated and they were sticking with the courier. I was told that because they are seperate payroll locations owned by a parent company, they get to consider my situation as me quitting and not layoff due to position elimination. I have not received severance and my hours do not count towards EI now. The only updates I ever heard from management was that the transfer was being worked on. Never any mention of it not happening.
Is it legal for them to register this as me quitting or am I owed severance? I was relying on the job in my new city and now I am stuck here with no employment.
